Overview
These Terms of Service (“Terms”) govern services provided by
Contractors Growth Partners (“CGP,” “we,” “us,” or “our”).
By purchasing our services, signing a project agreement,
authorizing payment, or otherwise engaging Contractors Growth
Partners to perform services, you agree to these Terms together
with any applicable proposal, project scope, service agreement,
invoice, checkout terms, or written agreement between you and CGP.
If a specific written service agreement or project scope
conflicts with these general Terms, the specific written
agreement will control for that project.
1. Our Services
Contractors Growth Partners provides digital services that may
include:
- Website design and development.
- Website redesigns.
- Website launch and implementation.
- Mobile optimization.
- Lead and contact form setup.
- Website maintenance and management.
- Content and service-page updates.
- Google Business Profile and local visibility support where specifically agreed.
- Other digital services described in an individual project agreement.
Services not specifically included in the agreed project scope are
not automatically included in the purchase price.
2. Project Scope & Agreements
Before or during a project, CGP may provide a written scope,
proposal, invoice, checkout description, or service agreement
describing the work to be completed.
Project details may include:
- Services being provided.
- Number or type of website pages.
- Design and development requirements.
- Estimated timeline.
- Revision allowances.
- Client responsibilities.
- Project fees.
- Recurring management services.
Requests that materially expand the original scope may require a
new quote or additional fee before the additional work begins.
3. Client Responsibilities
Clients are responsible for providing accurate information and
reasonable cooperation necessary for CGP to complete the project.
This may include providing:
- Business name and contact information.
- Services and service areas.
- Logo and branding materials.
- Project and company photographs.
- Business descriptions and company history.
- Approved license or certification information.
- Links to legitimate reviews or business profiles.
- Feedback and approvals within a reasonable timeframe.
- Access to domains or third-party accounts when necessary.
Clients should never submit passwords, banking credentials,
Social Security numbers, or unnecessary sensitive information
through CGP's general onboarding forms.
4. Payments
Fees are due according to the payment terms shown in the applicable
proposal, agreement, invoice, subscription, or checkout page.
By submitting payment information and completing a purchase, you
authorize CGP and its payment processor to charge the applicable
amount according to the payment terms presented to you.
Work may not begin until any required initial payment has been
successfully received.
Unless otherwise agreed in writing, payment for work already
completed is not refundable merely because the client later decides
not to use or launch the completed work.
Any refund or cancellation rights specifically provided in a written
service agreement will control over this general provision.
5. Monthly Website Management
When a client subscribes to recurring website management, the client
authorizes CGP to charge the recurring amount displayed at checkout
or stated in the applicable service agreement.
Website management may include reasonable ongoing services such as:
- Website maintenance.
- Reasonable text, photo, and service updates.
- Form and lead-delivery checks.
- General website monitoring.
- Performance and functionality checks.
- Website-related support.
Monthly website management does not automatically include major
redesigns, significant new page development, paid advertising,
advanced SEO campaigns, CRM development, or other services not
specifically included in the applicable management agreement.
A recurring service continues until canceled according to the
cancellation terms communicated at signup or in the applicable
service agreement.
6. Revisions & Changes
CGP wants clients to be satisfied with the direction of their
website and will provide revisions according to the applicable
project scope or service agreement.
A revision generally means a reasonable modification to work
already created. A major change in project direction, a complete
redesign after approval, significant new functionality, or
substantial additional pages may be considered additional work.
Additional work may require written approval and an additional fee.
7. Project Timelines
Any completion date or timeline provided by CGP is an estimate unless
a specific deadline is expressly guaranteed in writing.
Timelines may be affected by:
- Client response time.
- Delays in receiving content or approvals.
- Changes in project scope.
- Third-party platform limitations or outages.
- Technical issues outside CGP's reasonable control.
CGP is not responsible for delays caused primarily by missing client
information, approvals, credentials, or requested assets.
8. Client Content & Accuracy
Clients are responsible for the accuracy and legality of information
they provide to CGP.
By providing logos, photographs, written content, testimonials,
business information, licenses, certifications, or other materials,
the client represents that they have the right to provide and use
those materials for the project.
CGP may rely on information supplied by the client when creating
website content.
CGP does not intentionally fabricate customer reviews,
contractor licenses, certifications, awards, years in business,
project results, or other trust claims.
Clients are responsible for reviewing and approving factual business
information before publication.
9. Intellectual Property & Website Materials
Ownership of project deliverables may be further described in the
client's individual service agreement.
Unless otherwise agreed, clients retain ownership of the original
logos, photographs, trademarks, and business materials they provide
to CGP.
CGP retains ownership of its own pre-existing systems, processes,
templates, internal tools, reusable code components, methods,
know-how, and business materials that were not created exclusively
for a specific client.
Third-party software, fonts, plugins, stock assets, platforms, or
licensed materials remain subject to their respective third-party
license terms.
10. Third-Party Platforms & Services
CGP may use third-party services to provide or support client work,
including website platforms, hosting providers, domain registrars,
payment processors, form providers, CRM systems, analytics tools,
and communication platforms.
CGP does not control third-party systems and cannot guarantee their
uninterrupted availability, continued features, pricing, policies,
or performance.
Clients may also be subject to the terms and privacy policies of
those third-party providers.
11. No Guaranteed Business Results
CGP builds digital assets intended to improve a business's online
presentation, customer experience, and ability to convert online
visitors into inquiries.
However, business performance depends on many factors outside CGP's
control.
Unless explicitly stated in a separate written agreement,
Contractors Growth Partners does not guarantee a specific number
of leads, calls, customers, sales, revenue, search-engine rankings,
or business results.
Website performance may be influenced by traffic, market demand,
competition, pricing, reputation, advertising, search algorithms,
client responsiveness, location, seasonality, and other factors.
12. Suspension & Termination
Either party may end services according to the cancellation or
termination terms stated in the applicable service agreement or
subscription terms.
CGP may pause or terminate work if payments remain unpaid, a client
materially breaches an agreement, requests unlawful or deceptive
activity, abuses CGP staff or systems, or prevents CGP from
reasonably performing the agreed services.
Ending services does not eliminate payment obligations for work
already completed or fees already earned under the applicable
agreement.
13. Acceptable Use
Clients may not knowingly use CGP services to:
- Violate applicable law.
- Misrepresent licenses or professional qualifications.
- Publish knowingly false or deceptive claims.
- Infringe intellectual property rights.
- Distribute malware or malicious software.
- Engage in fraud or unlawful activity.
CGP may decline requests that would require us to knowingly publish
false, deceptive, unlawful, or infringing material.
14. Warranties
CGP will use reasonable professional efforts to perform the services
described in the applicable agreement.
Except for any express commitments contained in a written agreement,
services are provided without additional warranties to the maximum
extent permitted by applicable law.
15. Limitation of Liability
To the maximum extent permitted by applicable law, CGP will not be
responsible for indirect, incidental, special, consequential, or
speculative damages arising from use of the services, including lost
profits or lost business opportunities.
Nothing in these Terms limits liability that cannot legally be
limited or excluded.
16. Changes to These Terms
CGP may update these Terms as our services or business practices
evolve.
The “Last Updated” date at the top of this page identifies the most
recent version.
Material changes affecting an existing service relationship will be
handled in accordance with applicable agreements and law.
17. Governing Terms
These Terms are intended to be interpreted together with any
applicable written project agreement and in accordance with
applicable law.
If any provision is determined to be unenforceable, the remaining
provisions will continue to apply to the extent permitted by law.
